Investment Amount
- Invest at least $1.8 million in a new commercial enterprise, OR
- Invest at least $900,000 if the investment is made in a targeted employment area (TEA), which includes rural areas or areas with high unemployment.
Creation of Jobs:
- Create or preserve at least 10 full-time jobs for qualifying U.S. workers within two years of the investor's admission to the United States as a conditional permanent resident.
At-Risk Investment:
- The investment funds must be at risk for the purpose of generating a return on the capital placed at risk.
Lawful Source of Funds:
- Provide evidence that the investment funds were obtained through lawful means. Documentation such as tax returns, bank statements, business records, or other financial documents may be required.
Management or Policy Role (Direct Investment):
- The investor must be involved in the management of the enterprise or policy formation, either through day-to-day managerial control or through policy-setting activities.
Approval of Form I-526:
- Submit Form I-526, Immigrant Petition by Alien Investor, to the U.S. Citizenship and Immigration Services (USCIS) and have it approved.
Conditional Permanent Residence:
- Once the Form I-526 is approved, the investor and their eligible family members (spouse and unmarried children under 21) may apply for conditional permanent residence.
Removal of Conditions:
- Within the 90-day period preceding the second anniversary of the investor's admission to the United States as a conditional permanent resident, file Form I-829, Petition by Entrepreneur to Remove Conditions, to remove the conditions on permanent residence.
Approval of Form I-829:
- If USCIS approves the Form I-829, the investor and their family members become unconditional permanent residents of the United States.

To qualify for the EB-5 visa program, an individual must invest at least over $800,000 in a qualifying new commercial enterprise in the United States, create or preserve 10 full-time jobs, demonstrate that the investment funds were obtained legally, be admissible to the United States, and invest through an approved regional center. The investor must also be over 18, not a U.S. citizen or permanent resident, and may include their spouse and unmarried children under 21.
